EB discussed her arguments with the jury — all of which were statements about JD’s ex-lawyers’ countersuit against AH — and Elaine gave examples of why she thought his remarks were defamatory…mostly arguments, Abuse happened.

She also touched on how his comments affected her career – and said Walter Hamada himself – an executive at the World Bank – testified that Jason Momoa and James Wan emailed him Mail, insisting if they were to make a second movie together, Amber was also included.

The point about this is…why do those key characters in the movie say that unless there’s some sense that WB wants her out. Elaine argued that it was clear Amber’s star had been shot down – and asked the jury to award her reasonable damages.

That’s an interesting point…As many know, DV doesn’t just have to be a beating – it can of course be formed in other ways, emotionally, verbally, etc. That’s what Rottenborn is saying here – she may not have hard evidence, but what she has on the tape still supports her claims of abuse…and supports her claims as a victim.

Rottenborn goes on to list other meanings he thinks JD is outlining — including… if you do tell people, they’re lies; if you do document hurts, they’re false; if you’re trying to help your spouse, you Actually destroying them. BR said these ideas were dangerous and sought to be cemented by sentences, and they had a wider negative impact on DV victims.

He also said the jury is not here to decide whether JD actually abused Amber, but more specifically — whether her op-ed and alleged defamatory speech is protected by the First Amendment. He said the two statements in the actual body text were true on their faces, and she didn’t actually write the headline about “sexual violence.”

7:47 AM PT — Chew read the jury’s instructions with the actual jury, answered each question one by one, and explained why he felt he and his team explained each question – including what they’ve proven Johnny has no concept of abusing Amber. He also pointed out that when it comes to damages, JD doesn’t care about money or punishing Amber…he just wants to be rehabilitated and eventually restore his reputation in court.

He invoked his most famous character, Captain Jack Sparrow, and said JD would go to his grave knowing that some people who once looked up to him now believe he beat a woman for what AH did…. ..regardless of the outcome of this trial. He also said it wasn’t a #MeToo moment…because no one came out of the woodwork and said “me too”.

Her takeaway message…you either believe everything she says or you don’t. She insists that she and the team have proven through evidence and testimony that Amber was lying…and that Johnny was telling the truth – that is, she allegedly abused him, not the other way around. Amber’s lawyers would draw a picture of a man who had frequent violent outbursts, basically saying Johnny’s character was violent…even if he didn’t physically attack Amber, they would argue, he was ill-tempered, and they would use video and text to illustrate their point of view.
As for the defamation charge… Johnny and Amber are both public figures, so there must be evidence of actual malice to win.
There’s a ton of risk here…aside from court cases, verdicts can determine who has a career and who doesn’t.
While most outsiders are on the side, the jury may conclude that both Amber and Johnny are so unhinged that it is impossible to determine who was the aggressor, and the verdict may be opposed in Johnny’s defamation suit and Amber’s counterclaim .
By the way… Today marks the 6th anniversary of Amber’s court filing of her TRO, and it all kicked off. So, the timing of this thing is more dramatic. Guys, fasten your seat belts.
